The art in the 2020 SMFA Art Sale is being offered and sold by the School of the Museum of Fine Arts at Tufts University (SMFA at Tufts) under the following Conditions of Sale. Anyone registering to buy accepts the Conditions of Sale. These Conditions of Sale constitute the entire agreement between SMFA at Tufts and the buyer. A portion of the proceeds from the SMFA Art Sale (as selected by the artists) supports student financial aid at the School of the Museum of Fine Arts at Tufts. The school has collaborated with the online platform, Bidsquare, to market, promote and conduct the SMFA Art Sale. Additional terms and conditions of Bidsquare may apply to the buyer. The SMFA Art Sale is a buy now sale. Bidsquare will collect information including buyer’s name, telephone number, and address in accordance with its terms and conditions. The buyer consents to Bidsquare sharing this information with the SMFA at Tufts. The participating Artists provided all the artwork descriptions and images. SMFA at Tufts cannot guarantee or confirm the correctness of the item description or the condition of the artwork. The Artists and Bidsquare retain the rights to photographs, catalog text, and other intellectual property in the auction catalog and on the SMFA Art Sale websites. The installation images are computer generated and offered only to give an impression of the artwork after installation. Please be sure to check the item dimensions to ensure that it will work in your space. The participating artists set the price of the artwork in the SMFA Art sale. These values shall not be deemed a representation or warranty regarding the actual value of the property. All property is sold “as is”. Withdrawal and Cancellation: SMFA at Tufts and Bidsquare reserve the right to withdraw one or more artworks in the SMFA Art Sale for any reason and with no liability for such withdrawal. SMFA at Tufts reserves the right to cancel the SMFA Art Sale for any reason and with no liability for such cancellation. Time and Duration: The SMFA Art Sale opens to the public on November 9, 2020 and ends at 11:59pm, EDT on November 23, 2020. Payment: SMFA will send invoices for purchased works within 24 hours of purchase. Payments are due within twenty-four (24) hours of the receipt of the invoice. If payment for any artwork is not received in full within twenty four (24) hours of the invoice's delivery, SMFA at Tufts reserves the right to cancel the sale. The buyer is responsible for applicable taxes (including sales tax), insurance costs and shipping and delivery charges. Such amount shall be payable in U.S. Dollars. All sales are final. No refunds will be given for any reason. Collection of Property: Unless otherwise noted in an item listing, artwork will be available for in-person pickup at SMFA at Tufts, 230 Fenway, Boston, MA, December 12-15, 2020, by appointment. Is there a number to call to arrange for pickup? If artwork is not picked up by the close of business on December 15, 2020, artwork will be shipped to the buyer. Shipping and insurance can be arranged directly between the buyer and the U.S.Art. The buyer is responsible for any shipping, delivery, and insurance charges.
